Terms and Conditions of Sale

These Terms and Conditions of Sale (hereinafter referred to as the "General Terms and Conditions") regulate the sale of products carried out remotely via computer network on the www.ljudesign.it website of Liuva Maqueira Gomez, with registered office in Terni, Via della Bardesca 5, VAT no. IT01565770557, email: info@ljudesign.it, in order to ensure maximum transparency and clarity in relations with users.
The products viewable on the www.ljudesign.it website are handmade by Liuva Maqueira Gomez.
All sales and purchase transactions between the Vendor and the Customer will be governed by the following General Terms and Conditions, which may be amended at any time by updating the website.

  • Registration

The users who want to buy on ljudesign.it and use the services on the site must register. The user who registers declares that he/she has read the Privacy Policy and that the personal data entered is true and correct, assuming full responsibility for the information provided. In the event of changes, the user must promptly inform the Owner.

  • Acceptance of the conditions of sale

The contract stipulated between the company Ljudesign di Liuva Maqueira Gomez and the customer must be considered concluded following the indicated procedures. By placing an order in the manner provided, the Customer declares that he/she has read all the information provided during the purchase procedure and fully accepts the general conditions of sale.

  • Availability of the products and execution of the orders

The electronic commerce system adopted on the website ljudesign.it is conceived to guarantee to the Customer the maximum transparency, indicating in real time the exact state of availability of the Products and relative delivery times.
However, we have to consider the fact that several users can place orders for the same article/s at the same time and consequently vary the quantity of products in our warehouse. In this case, we shall notify the Customer by telephone or e-mail of any problems related to product availability, at which point the Customer is free to decide whether or not to cancel the order. In case of cancellation the customer will be immediately refunded the amount paid.
Ljudesign reserves the opportunity to process even only partial orders received according to the availability of products in stock.
We also remind you that the images and information contained in the product sheets are indicative and sometimes may not fully correspond to the actual characteristics of the article, although we show great care and attention in this regard.

  • Orders

Orders are accepted exclusively via the Internet (online). The customer who sends the order directly from the website will receive, at the end of the procedure, a communication by electronic mail (e-mail) confirming that the order has been placed, indicating the relevant order number. In the event that, after the order has been sent, the order number does not appear (after a few minutes), the proposal shall be considered as not accepted, for all legal purposes, even if for accounting, administrative or product shortage reasons.
It is possible to cancel an order only if the order has not yet been processed and the goods have not yet been shipped, either by telephone or by written communication to be sent by e-mail to info@ljudesign.it.
For orders that have already been processed, the customer must exercise the Right of Withdrawal.

  • Selling prices

All sales prices displayed on the ljudesign.it website are indicated in Euros and include VAT. They are subject to change without notice. The shipping costs, except in exceptional or promotional cases, are charged to the Customer and are clearly displayed before the order is completed. In case of discrepancies in prices, following the Customer's order, these will be immediately communicated to the Customer by telephone or by e-mail who, without any penalty, may withdraw from the purchase commitment made.

  • Delivery methods and times

Shipments are made exclusively by courier, which delivers within 5-7 working days (with some exceptions) after the order has been processed throughout Italy. Transport costs are charged to the customer, clearly visible at the moment of the order. For uninsured goods, Ljudesign does not assume any responsibility for the loss, tampering or breakage of the product(s) purchased and for any delays in delivery by the shipping companies.

  • Complaints and returns

Upon receipt of the goods, the Customer shall immediately check their condition and conformity. Complaints relating to the conformity of the products, also in relation to their quantity and/or external appearance, must be made in writing using the appropriate procedure and the authorised material return request (RMA) form. The goods must be sent carriage paid to our premises accompanied by a transport document on which the RMA number must be indicated. Goods without this number will not be accepted. In case of a RMA request for a faulty or damaged product, if the returned product is undamaged, Ljudesign reserves the right to charge the cost of transport for the return of the goods, and a flat rate as reimbursement for technical costs of € 25.00 + VAT. If the return is accepted, the refund will be made net of shipping costs.

  • Unconditional right of withdrawal

Legislative Decree no. 206 of 6 September 2005 on the protection of consumers in respect of distance contracts provides for the possibility for the consumer to exercise the unconditional right of withdrawal. The consumer will be required to return the purchased products already received in perfect condition and in their original packaging intact, not opened or worn and will be required to pay the cost of return. In the event that the purchased goods have been opened, damaged, installed or assembled, the consumer will not be able to avail himself of the unconditional right of withdrawal as this alters the condition of the goods and the packaging or if personalised products are requested. The seller will refund the consumer the sum already paid for the product purchased, net of the costs incurred to deliver the same product. The seller reserves the right to retain the amount necessary to provide for the re-packaging (in case the original packaging is damaged or lost) or the restoration of the product. Below are the terms and procedures on how the customer can make use of the right of withdrawal.
The time limit to make use of the right of withdrawal is 14 days from the receipt of the goods within which the customer must inform us by registered letter A/R to the address: Ljudesign di Liuva Maqueira Gomez, Via della Bardesca 5 - 05100 TERNI

  • Transactions

All online banking transactions are handled through the service offered by Paypal and consequently the supplier is not responsible for any anomalies or problems relating to these transactions.

  • Applicable law and competent court

This agreement is governed by Italian law. Any dispute arising out of the interpretation and execution of this agreement shall be settled by the Court of Terni.
